Current Legal Status

There are currently two lawsuits and one ROC complaint at play over the bones of this company. Unfortunately the winners will likely be the accountants and attorneys in this matter and the losers will be the participants, vendors and subcontractors. I have already decided that the new Swimming Pool Contracting company that I am currently in the process of establishing with two new partners will be extending warranty coverage to the pools built for the customers of Splash Custom Pools and Spas (SplashWorks, LLC - not Splash Custom Pools and Spas, LLC) because they are one group who absolutely should not have to bear the brunt of this nonsense.

We have already established this as a policy and while we are not even up and functioning as a company yet we have already done warranty work for these customers. Although Mike as the qualifying party on the license at the time these pools was built is obligated to perform this work he has said that if someone else works on the warranties on these pools he will refuse to also provide service. Even with this warning most of the customers who have called for repair work and been informed of this have decided to elect to have us perform this after the sale service for them.

We are currently reviewing which of the claims in our Counterclaim against Mike belong to me personally and which belong to the Limited Liability Company to pursue through the Receiver.

Plaintiffs SPLASH CUSTOM POOLS AND SPAS, L.L.C., an Arizona limited liability company; SPLASH POOLS, INC., an Arizona corporation; MARC D. MAPLES, a single person,	COMPLAINT (Civil - Business Defamation, Trade Name/trademark Infringement and Unfair Competition, Tortious Interference, Injunction	They have to decide if they want to pursue this suit since they have now been shot down in the opening salvo.	•	Put a Fork in them, they are done! They Settled their case by making restituion to me for attorney fees
Defendants SPLASHWORKS, L.L.C., an Arizona limited liability company, dba "SPLASH CUSTOM POOLS AND SPAS"; DAVID W. The TRUTH is a defense and you cannot sue someone for libel and slander if they are telling the truth. If you do not like what someone is saying about you and the statements are true - stop doing that which is wrong

Respondent License No. 098623, Class B-05 of Southwest Aqua Structures (OWN)		They filed their answer with the ROC but did not deliver a copy of their answer to me as per the ROC's instructions. "A copy of your answer must be mailed to the Complainant."	•	License REVOKED!!!
